1. Purpose
These Terms and Conditions of Sale govern the contractual relationship between Calyferias, NIF 515955124, hereinafter “the Company”, and any individual or legal entity, hereinafter “the Client”, booking a short-term holiday rental in the Algarve, Portugal.
Any booking implies full acceptance of these Terms, which prevail over any other conditions.
2. Description of services
Calyferias offers seasonal rentals of villas, houses and apartments located in the Algarve. Services include the accommodation itself, bed and bath linen, arrival and departure cleaning, and local assistance during the stay.
The features of each property are described on its listing page. Photographs and descriptions are provided for information purposes and are not contractually binding.
3. Booking
The booking is initiated by the Client on the Calyferias website. It becomes firm once confirmed in writing by the Company and after payment of the deposit or the full amount, depending on the option chosen.
The Client undertakes to provide accurate information and to disclose the identity of all occupants. The number of guests may not exceed the maximum capacity stated on the listing.
4. Prices and payment
Prices are stated in euros and include the rental of the property, standard utilities (water, electricity, gas, internet) and service fees. Tourist tax, any extra-guest supplement and the security deposit are specified at the time of booking.
Two payment methods are available: full payment when the request is approved, or payment in two instalments with a 40% deposit on approval and the remaining 60% due one month before arrival.
In the event of late payment, Calyferias reserves the right to cancel the booking and apply the corresponding cancellation terms.
5. Security deposit
A security deposit may be requested before arrival. It is refunded within 7 days after departure, less any damage observed or additional charges not included in the package.
6. Cancellation
Any cancellation request must be sent to Calyferias in writing. The financial cancellation terms are specified in the booking quote and depend on the time between the request and the scheduled arrival date.
In the event of late cancellation or no-show, the total amount of the stay remains payable to Calyferias.
Calyferias reserves the right to cancel a booking in cases of force majeure. In that case, the Client is refunded all amounts already paid.
7. Check-in and check-out
Check-in and check-out times are indicated on each listing. Early check-in or late check-out must be approved by Calyferias and may incur an additional fee.
The Client undertakes to return the property in the condition in which it was found, to comply with the house rules and not to disturb neighbours.
8. Liability
Calyferias undertakes to make the property available in a condition consistent with its description. The Company cannot be held liable for disturbances caused by neighbouring works, weather conditions or any event beyond its control.
The Client is liable for damage caused by themselves or their party during the stay. Clients are advised to hold civil liability and travel insurance.
9. Insurance
The Client is responsible for their personal belongings during the stay. Calyferias accepts no liability for theft, loss or damage to personal property.
10. Personal data
Data collected when booking is required to process the request and manage the stay. Full details of processing are set out in our privacy policy (GDPR).
11. Intellectual property
All elements of the Calyferias website (texts, photographs, logos, graphic design) are protected by intellectual property law. Any reproduction or use without prior authorisation is prohibited.
12. Applicable law and disputes
These Terms are governed by Portuguese law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing agreement, the Portuguese courts shall have jurisdiction.
